CA Prop 65 list has been updated with 2 New Substances which are probably carcinogenic to humans

The Office of Environmental Health Hazard Assessment (OEHHA) has added two new substances to California's Proposition 65 list, effective April 21, 2023. The two substances added are

  1. 1,1,1-trichloroethane (CAS Registry Number 71-55-6)
  2. leucomalachite green (CAS Registry Number 129-73-7)

The purpose of adding these substances to the list is to inform the public about their potential cancer-causing properties. The listing of these chemicals is based on the Labor Code mechanism, as outlined in Health and Safety Code section 25249.8(a), which incorporates California Labor Code section 6382(b)(1) into Proposition 65. The law requires that certain substances identified by the International Agency for Research on Cancer (IARC) be listed as known to cause cancer under Proposition 65.

The decision was made based on a public notice published on March 3, 2023, in the California Regulatory Notice Register. During the public comment period that followed, which lasted from March 3, 2023, to April 3, 2023, no comments were received.

The addition of these two substances to the Proposition 65 list means that businesses will have to provide warnings to Californian consumers if their products contain these chemicals above a certain threshold. This update serves as a reminder to businesses to be mindful of the chemicals they use and to ensure that their products comply with California's strict safety standards.

The warning requirement for significant exposures to these chemicals will take effect on April 21, 2024.
